Former UN officials call for swift action against war leaders from the ICC court

The Myanmar Advisory Council (SAC-M), which is made up of former UN officials, issued a statement yesterday calling for the International Criminal Court (ICC) to take action against the Burmese military, which has committed brutal human rights violations but has been impunity.

Former UN officials have pointed out that the Burmese military has been brutally committing human rights violations since the 2021 coup d’etat, and will continue to do so without stopping throughout 2022.

Ms. Yanghee Lee, a former UN human rights representative for Myanmar, said, “The human rights situation in Myanmar has gotten even worse this year. Min Aung Hlaing and his generals will continue to commit atrocities against the people of Myanmar. They will continue to do so until it can stop. The international community needs to do everything possible to prosecute these generals at the ICC Court.”

Responsible Burmese military leaders, terrorist acts will stop only if accountability can be made. In order to do this, the ICC Court has the opportunity to take action and must take action, according to the statement of the Myanmar Advisory Council. A brief explanation of what action can be taken was also released yesterday.

Chris Sidoti, a member of the Special Advisory Council, said, “We have been asking Min Aung Hlaing and his generals to be prosecuted for genocide, crimes against humanity, and war crimes since 2018. The National Unity Government (NUG) has submitted that the ICC has jurisdiction over Myanmar, so the ICC has the right to judge the genocide, crimes against humanity, and war crimes in Myanmar. International organizations, including the ICC, should not leave Myanmar without justice for another year.”

In August of this year, the National Unity Government (NUG) submitted that it would accept the trial of crimes committed by the ICC in Myanmar.

In 2019, the ICC court started a fact-finding investigation into the issue of the Rohingyas fleeing to Bangladesh due to the Myanmar army’s genocide. But he points out that this test is limited.

In a brief explanatory report on how the ICC court can take action against Myanmar’s military leaders, not only the crimes committed against the Rohingya, but also ethnic minorities. The actions of the Burmese army, which have been committed against the civilian population for many years, SAC-M said it explained how legal action could be taken against crimes committed after the coup.

Marzuki Darusman, a member of the Special Advisory Council, also criticized the establishment of the ICC Court to take action against anyone who commits a crime. If Myanmar’s military leaders cannot be prosecuted by the ICC Court, there is no point in establishing the ICC Court.

Ambassador U Kyaw Moe Tun, who was re-elected as Myanmar’s representative to the United Nations, said in an interview a few days ago that in order to take action against the Myanmar military through the International Criminal Court (ICC), a proposal from the UN Security Council is needed.

The International Criminal Court (ICC) based on the findings of the Independent Investigation Mechanism (IIMM) on Myanmar established by the United Nations. U Kyaw Moe Tun also said that the time has come for the International Court of Justice (ICJ) to take action against the coup military council.
